Lancaster Way Business Park is a large commercial and industrial estate in Witchford, Suffolk, that incorporates several original buildings from its’ time in operation as a WWII airfield, one of which is a Nissen Hut let by our client.  The three properties included in the dilapidation covers approximately 1 acre of land. 

Our client’s lease on three of the units were coming to an end and the Landlords had served a Terminal Schedule of Dilapidations on our Client, claiming approximately £125,000 in respects to repairs. 

The Client’s lease was onerous with ‘Put and Keep’ clauses.  Much of the claim was to replace asbestos roofs and carry out repairs or replace 80-year-old building fabric. 

JBH Property Consulting were instructed on behalf of the Tenant to negotiate a cash settlement so that the buildings could be handed back to the Landlord.

We reviewed the lease, the Landlords Terminal Schedule of Dilapidations and undertook a full inspection of the properties.  Armed with this information and our knowledge of dilapidations law, we were able to counter all arguments made by the Landlords surveyor and agreed a full and final settlement of £40,000, amounting to a 68% saving on the original claim.
