Party Wall – The Law

The Party Wall etc. Act 1996 provides a strict process that is time critical before works commence that will affect a neighbouring property. This includes requirements for building owners to serve a detailed notice of intent to carry out works. Consent must be provided in order to undertake these works and in the event that consent is not provided, a dispute is deemed to have arisen. Party Wall Surveyors must be appointed in order to resolve the dispute with a Party Wall Award. A Schedule of Condition (SoC) is also recommended prior to commencement of works to provide clarity on the original condition of the affected site.
